site or online agency site signing up at modelsactorssingers.com as a member and
then actively soliciting modelsactorssingers.com members to join their competing
website or online agency, shall result in the termination of the membership without
refund.
19. Every user shall avail of the facilities available in the site for her/his bona
fide interests with respect to the relevant field and shall desist from entertaining
any mala fide or malicious intentions or interests with respect to the same.
20. No member shall make public the e-mail address or other contact address or telephone
number through the member messages or otherwise. Any act to the contrary shall be
so done without the approval and against the messaging policy of modelsactorssingers.com.
Any communication of offer, acceptance, agreement or actions thereon shall be at
the recipient’s sole risk and responsibility.
21. Every user/member shall adhere to the guidelines as posted throughout the site

that modelsactorssingers.com and its affiliates are not responsible for the accuracy
or bona fides of the content of those links. Users are strictly prohibited against

rule shall entail the removal of the profile of the user concerned.
27. Users are warned against posting sexually explicit images to the web pages.

information such as user name, email address, etc. If, by any act of negligence
or omission or commission on your part such as displaying the same on a bulletin
board or in a chat room and such information is subjected to unauthorized use giving
rise to the posting of unsolicited messages from others, the sole responsibility
for such posting shall rest upon you.
29. Members of modelsactrossingers.com will receive regular email updates and will
be contacted by other system members seeking to work with you, and you will receive
occasional email from the administrators. Also, when new features are added and
developed you will be informed or included in these new features and enhancements,
some of which may be email based. On our part, we will endeavor to limit email contact
as much as possible from the system administrators. However, where an email is sent
and returned with an email bad address, we will attempt to locate a correct address
from any linked website, and failing which, your profile will be disabled. In that
event, you may contact us with the correct information and your profile will be
reactivated.
30. Modelsactorssingers.com reserves the right to alter, amend or add to these terms
and conditions any time without prior notice and the same shall be published in
website and the users/members shall be deemed to have taken timely notice of the
same and the same shall be binding on the existing users/members.
31. MEMBERSHIP SUBSCRIPTION & RENEWAL: Membership of modelsactorssingers.com
is availed and maintained through subscription and renewal. All subscriptions are
renewable at the end of the subscription term. In normal course, no intimation soliciting
the renewal of the subscription shall be issued to the members. The members shall,
in their own interest and initiative, see to it that the subscription is renewed
before the expiry date of the subscription term by way of effecting the payment
of the subscription renewal amount through the prescribed modes of payment. Therefore,
the members may, for their convenience, keep a record of their due subscription
dates for the future terms.
32. A grace period of 15 days is granted for those members who fail to renew the
subscription by the due date. If the Membership Subscription is not renewed even
within the grace period of 15 days after the due date of renewal, the membership
shall be deactivated and kept under suspension until renewed. The member is at liberty
to renew the membership any time by effecting the payment of the subscription fee
for the subsequent term. S/he is not under any liability to pay any fee for the
interim period.
33. CANCELLATION: If a member, who has opted for the payment mode of remittance
through the PayPal Account, elects to cancel the subscription of the membership,
s/he shall have to cancel it directly at the member’s own PayPal Account. It is
the responsibility of such members to cancel their subscription prior to the renewal
date though their PayPal account. For example, if the date of renewal falls on June
10, the membership needs to be cancelled prior to June 10, and not later than June
9. Since modelsactorssingers.com does not have access to the member’s PayPal account,
the company will not be able to cancel the member’s subscription at PayPal.com.
If any such member fails to cancel his/her subscription directly through PayPal,
modelsactorssingers.com will not be responsible for any billings by PayPal.
34. REFUND POLICY: The subscription fee once remitted shall not be refundable under
any circumstance whatsoever. It is primarily because of the immediate access nature
of the Internet and the website. Members get immediate and full access to the site
and its services and also they cannot physically return the member services of an
online portfolio.
35. MEMBERSHIPS: Modelsactorssingers.com offers two kinds of memberships – (a) General
Membership and (b) Special Membership. The General Membership is intended for everyone
who wishes to sign up as a member and avail of the facilities offered by the website.
This is primary membership mandatory for everyone desirous of signing up with the
site – aspiring/budding models, actors, singers and other artistes on the one hand
and those who wish to avail their services, such as modeling agencies, film producers,
directors, photographers, scouts, etc.
36. The Special Membership is in fact an additional membership intended for the
latter group of members as aforesaid, such as modeling agencies, film producers,
directors, photographers, scouts, those who want to contact the members for hiring
their service, etc. However, there is no additional fee for the Special Membership.
37. The Membership is subject to these terms and conditions/rules and regulations
and any other or further rules and regulations, directions, strictures or stipulations,
in any form and in any manner whatsoever that are or may be, notified through this
site or through other media from time to time. The non-compliance of any of them
shall result in the immediate termination of the membership and the member shall
forfeit her/his rights there under including the membership subscription fee.
38. The membership is offered for a prescribed subscription fee which may vary from
time to time and the same will be notified in time. Once the payment for the prescribed
subscription fee or its renewal is effected, the amount shall neither be refunded,
nor be transferable to or adjustable against any other membership, or account, under
any circumstance whatsoever.
39. The membership application is to be submitted in the prescribed online application
form as well as in the downloadable hard copy. As soon as the online application
is submitted along with remittance of the prescribed fee, your membership comes
into force. However, your membership shall be activated only on the receipt of your
hard copy application in due form with the required documents at the company office.
40. You shall ensure before submitting your application, both online and hard copy,
that it is complete in every respect along with the mandatory documents. Any default
or defect with respect to the same shall result in the non-activation of your membership.
41. . MINORS: The Company is duty bound to protect the interests of the minors.
Therefore, it is mandatory that persons who have not completed 18 years of age as
on the date of application shall apply only through their lawful guardians. The
guardian shall submit the application in his name to avail the services of the website
for the benefit of her/his ward. In such event, the
guardian shall hold the sole responsibility to take abundant and utmost care and
caution to see to it that the individual safety and security of
the minor is protected.
42. In order to protect the minor’s security interest, the website shall publish
only the photograph, name and location of the minor. It shall be the guardian’s
contact address, telephone number and other information that will be given. Therefore,
it shall be the sole responsibility of the guardian
to preserve and keep under cover the personal identity and contact information of
the minor in order to safeguard the security interest of the minor.
43. In any dealing with any member or others contacted through this website, it shall be the sole legal responsibility of the guardian
to gather beforehand, direct information about the deal and the parties involved
so as to ensure the bona fides of the deal as well as the parties
involved and thereby to ensure that the minor’s interests are protected. The guardian
shall take it as his sole responsibility that under no circumstance the minor be
let to have direct contact in such dealings.
44. Photographs of the minors to be posted on the website shall be subject to pre-censoring
and therefore such photographs be sent to the Company office where it shall be censored
before posting on the site. Such photographs shall not be in any fashion that may
tend to be indecent or affecting the moral character or individual image and estimation
of the minor.
45. The promotion and recruitment of escorts, escort services, personal companions,

banned. Members shall desist from activities such as soliciting for, recruiting,

such membership shall be terminated with no refund. Such activities include (but

good faith and professional ethics. However, if any user or member acts upon the
statement, offer, promise or assurance of any other members or others, it shall
be at their own risk and responsibility. Modelsactorssingers.com does not undertake
any responsibility for any such dealings.
47. Modelsactorssingers.com is under no obligation to provide exposure to other
sites through links or other methods in portfolio and may remove those at its sole
discretion, and with out notice. The referral system of the website is intended
for work related offers and general enquiries related to or leading to work or further
discovery. Promotion of services and goods is not an appropriate use of the referral
system. Modelsactorssingers.com permits one main member portfolio per person. Managers,
agents, photographers, etc. who have been authorized to post on behalf of their
clients may control the Model and actor portfolios in addition to their manager,
agent or photographer portfolio.
48. Members are required to comply with strict adherence to these rules and regulations,
and any non-compliance shall result in the termination without refund of your membership
fee.
49. This User Agreement and any disputes arising out of or related to the service
and the site shall be governed by, and construed and enforced in accordance with
the laws of India and any proceedings with respect to any such disputes shall be
subject to the jurisdiction of the courts in Gurgaon, the State of Haryana, India.
